Revised Terms & Conditions for Homefoodi

Effective Date: August 25, 2025

I. Acceptance of Terms

Thank you for using Homefoodi. These Terms of Service (the “Terms”) are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the Homefoodi website at www.homefoodi.com (the “Site”) and any related mobile or software applications (“Homefoodi Platform”) as a local search and discovery service for Food Suppliers.

These Terms are effective for all existing and future Homefoodi users.

Please read these Terms carefully. By accessing or using the Homefoodi Platform, you are agreeing to these Terms and concluding a legally binding contract with BLD Dine Homes Pvt Ltd (hereinafter referred to as “Homefoodi”). Your use of the Homefoodi Platform signifies your acceptance of these Terms and your agreement to be bound by them.

Crucially, you understand and agree that Homefoodi is a listing platform only. We are not an aggregator, food delivery service, or payment processor. We are not a party to any transaction or communication between you and any Food Supplier. Your use of the Homefoodi Platform is at your own risk, including the risk that you might be exposed to content that is inaccurate, objectionable, or otherwise inappropriate.

You may accept the Terms by:

  • Clicking to accept or agree to the Terms, where this option is made available to you.

  • Actually using the Services. In this case, you understand and agree that Homefoodi will treat your use of the Services as acceptance of the Terms from that point onwards.


II. Definitions

  • Customer (“You” or “Your”): Refers to you, as a user of the Services. A customer is someone who accesses the Homefoodi Platform to discover, find, and connect with Food Suppliers.

  • Content: Includes reviews, images, photos, location data, and all other forms of information.

    • “Your Content” is content that you upload or share, such as ratings, reviews, photos, or profile information.

    • “Homefoodi Content” is content that Homefoodi creates and makes available, such as graphics, design, and other elements of the Services, excluding Your Content and Third Party Content.

    • “Third Party Content” is content that comes from parties other than Homefoodi or its Customers, primarily the Food Suppliers themselves.

  • Food Supplier(s): Refers to the Home Chefs, Tiffin Suppliers, Caterers, and other food providers listed on the Homefoodi Platform.


III. Nature of Homefoodi Platform and Services

  1. A Listing and Discovery Platform: Homefoodi provides a platform where Food Suppliers can list their services and Customers can discover them. We are solely a local search engine and do not participate in the food ordering, payment, or delivery process.

  2. No Transactional Role: Homefoodi is not involved in the transaction between Customers and Food Suppliers. Customers must contact Suppliers directly to negotiate prices, place orders, arrange for payment, and coordinate delivery.

  3. Disclaimer of Liability for Food & Services: Homefoodi holds no responsibility or liability for the quality, safety, preparation, pricing, or delivery of any food or service provided by the Food Suppliers. Any disputes or issues regarding the food, payment, or delivery must be resolved directly between the Customer and the Food Supplier. Homefoodi will not act as a mediator.

  4. Supplier-Provided Information: All information on the Homefoodi platform, including indicative pricing, menus, location, and contact details, is provided and managed by the Food Suppliers. Homefoodi does not verify or guarantee the accuracy, completeness, or timeliness of any listing. Customers are advised to verify all information directly with the Supplier.

  5. No Endorsement: A listing on the Homefoodi Platform does not constitute an endorsement, guarantee, or warranty by Homefoodi of the Food Supplier's quality, reliability, or compliance with applicable laws and regulations (e.g., food safety standards, FSSAI registration).

  6. Right to Modify Services: Homefoodi is constantly evolving. You acknowledge and agree that the form and nature of the Services may change from time to time without prior notice. Homefoodi reserves the right to suspend or discontinue any part of the Services at any time.


IV. Use of the Platform

  1. Account Creation: You must create an account to use certain features. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. All information you provide must be true, accurate, and correct.

  2. Permitted Use: You agree to use the Services only for purposes that are permitted by these Terms and any applicable law. You agree not to access the Services through any automated means (e.g., scripts or web crawlers).

  3. Telephony Services: To connect you with Food Suppliers, we may provide value-added telephony services that record call information and conversations for quality and improvement purposes. If you do not wish for your information to be recorded, please do not use these telephone services.

  4. Prohibited Conduct: You will not engage in any activity that interferes with or disrupts the Services. You agree not to post any Content that is false, defamatory, abusive, hateful, or in violation of our content guidelines or any applicable laws. This includes posting inauthentic reviews or engaging in any form of commercial spam.


V. Content

  1. Ownership: Homefoodi exclusively owns all rights to the Homefoodi Content and the intellectual property associated with the Services. You may not modify, reproduce, or exploit any of the Homefoodi Content without our express authorization.

  2. Your License to Homefoodi: By submitting Your Content, you grant Homefoodi a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, display, distribute, modify, and commercialize Your Content in any media. You waive any claims of moral rights or attribution with respect to Your Content.

  3. Responsibility for Your Content: You are solely responsible for Your Content. You represent and warrant that you are the author and owner of Your Content and that it is truthful, accurate, and does not violate any third-party rights or applicable laws.

  4. Content Removal: We reserve the right, at any time and without prior notice, to remove, block, or disable access to any Content that we consider to be in violation of the Terms or otherwise harmful to the Services.

  5. Customer Reviews: Customer reviews are the personal opinions of the reviewer and do not reflect the opinion of Homefoodi. We are a neutral platform and do not arbitrate disputes arising from reviews. A Food Supplier’s best recourse for a review they believe to be untrue is to post a public response or contact the reviewer directly.


VI. Disclaimer of Warranties, Limitation of Liability, and Indemnification

  1. Disclaimer of Warranties: THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HOMEFOODI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE CONTENT PROVIDED BY FOOD SUPPLIERS. HOMEFOODI ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR INTERACTIONS WITH A FOOD SUPPLIER, (III) ANY BUGS, VIRUSES, OR MALICIOUS CODE TRANSMITTED THROUGH THE SERVICES, OR (IV) ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT.

  2. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEFOODI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY LOSS OR DAMAGE INCURRED BY YOU AS A RESULT OF ANY RELATIONSHIP, AGREEMENT, OR TRANSACTION BETWEEN YOU AND ANY FOOD SUPPLIER WHOSE LISTING APPEARS ON THE SERVICES. HOMEFOODI’S LIABILITY IS STRICTLY LIMITED TO ISSUES DIRECTLY ARISING FROM THE FUNCTIONING OF ITS PLATFORM AND NOT FROM THE OFFLINE INTERACTIONS OR TRANSACTIONS THAT RESULT FROM ITS USE.

  3. Indemnification: You agree to indemnify, defend, and hold harmless Homefoodi and its officers, directors, employees, and agents from any claims, damages, losses, and expenses arising from (i) Your Content, (ii) your use of the Services, (iii) your violation of these Terms, or (iv) your violation of any rights of another party, including any Food Supplier.


VII. Termination

You can delete your account at any time. We may terminate or suspend your access to the Services at our sole discretion, without notice, for any reason, including a violation of these Terms. We shall not be liable to you or any third party for the termination of your access to the Services.


VIII. General Terms

  1. Governing Law: These Terms shall be governed by the laws of India. The Courts of New Delhi shall have exclusive jurisdiction over any dispute arising under these terms.

  2. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Homefoodi concerning the Services.

  3. Severability: If any provision of these Terms is deemed invalid by a court, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

  4. No Agency: No partnership, agency, or employment relationship is created as a result of these Terms, and you do not have any authority to bind Homefoodi in any respect whatsoever.


IX. Grievance Redressal Mechanism

For any issue related to the use of the Homefoodi Platform (e.g., technical problems, content policy violations, or issues with your account), you may contact our Grievance Officer.

Please note: Homefoodi's grievance mechanism does not cover disputes between Customers and Food Suppliers. Such issues, including but not limited to disagreements over food quality, pricing, payment, or delivery, must be resolved directly between the parties involved.
